The Federation Council has found a way to limit the growth of marketplaces – they may be prohibited from opening new order pick-up points in those regions where they occupy a quarter of the market. The proposal was made by the Chairman of the Federation Council Committee on Economic Policy, Andrei Kutepov, writes Forbes. He outlined the initiative in a letter to Presidential Aide Maxim Oreshkin and formalized it into a bill. Work on it is still underway, the senator clarified in an interview with Kommersant FM.

Meanwhile, the idea has already been criticized in the market. Such a restriction will primarily harm customers, Ekaterina Smirnova, a partner at D&A Partners, is sure: “In fact, this is not even a restriction on online business, but a restriction on user convenience.

You can be a marketplace with any turnover, but if we limit the number of pick-up points and fewer users get access to goods, then it becomes less convenient for them.

Conventionally, if your order pickup points are concentrated in Moscow and not in St. Petersburg, then another marketplace will become more popular in the Northern capital. How does this happen in the real sector? Let’s take the classic Standard Oil case, which started antitrust in the world: it was forcibly divided into two companies, and they began to compete with each other on price. There the user was not harmed.

At the same time, the Federal Antimonopoly Service, in fact, did not say anything out of the ordinary about marketplaces, and, secondly, did not say anything about illegality. Wildberries, Ozon demonstrate collective dominance, but this does not mean the presence of illegal actions. In general, a dominant position in the market is an absolutely legal situation, and companies cannot be punished simply for market share or business size.”

The marketplaces themselves do not comment on the initiative, but the Association of Internet Trade Companies called the idea “not only redundant, but also harmful.” The ban on opening order pick-up points will not hit marketplaces, but their partners, small businesses, AKIT President Artem Sokolov is sure: “Marketplace opens its distribution centers, organizes fulfillment in the regions, and begins to actively develop small businesses in these locations. Logistics services and new order delivery points are opening. Of all the existing pickup points, the main part are partnership ones, that is, those that were opened by local entrepreneurs.

As soon as we set these restrictions, we essentially block the opportunity for local regional businesses to continue their development with sites: to sell goods and open delivery points.

I am sure that the legislator did not intend to limit the ability of people to earn money in this way. But so far the initiative, unfortunately, sounds exactly like this.”

According to the Federal Antimonopoly Service, Wildberries and Ozon together occupy about 80% of the marketplace market. Such a dominant position is not yet a violation, the department clarified.
