Logistikaspetstrans LLC filed a lawsuit against H&M with the Moscow Arbitration Court demanding to recover damages in the amount of 245.8 million rubles. for non-compliance with assurances on sustainable business development, Vedomosti found out. The plaintiff’s representatives emphasize that Logistikaspetstrans, relying on H&M’s promises, went for the targeted purchase of 50 vehicles that meet H&M’s requirements and the volume of applications, having concluded the relevant financial lease (leasing) agreements. The company also organized a motor transport base, as required by the tender conditions put up by H&M. But in July 2022, the H&M Group officially announced the curtailment of business in Russia, contrary to its earlier commitments, the authors of the lawsuit emphasize.
As a result of the suspension of H&M sales in the Russian Federation in 2022, the volume of cargo transportation under the contract decreased significantly, but Logistikaspetstrans was forced to continue to bear the costs of transport, Oleg Mamont, head of atLegal, a law firm representing the interests of the plaintiff, explained to Vedomosti. These losses, he said, are in direct causal relationship with the actions of H&M. In addition, a direct consequence of the inaccuracy of H&M’s representations and failure to fulfill business development obligations is loss of profits. Based on this, the contractor requires damages in accordance with Part 1 of Art. 431.2 of the Civil Code (unreliable assurances about the circumstances relevant to the conclusion of the contract and its execution).
