Huawei branded stores, operated by Premium Retail LLC, do not sell telephones, laptops and other basic products displayed in the trading floors, Kommersant correspondents were convinced. Stores in Moscow’s Afimoll, Aviapark, and Gagarinsky are open to the public, but most price tags have “not for sale” or “demo” signs. The situation is similar in Huawei stores in Novosibirsk, Chelyabinsk and Tyumen. In individual stores you can buy headphones, cases, protective glasses and other accessories. The buyer cannot demand the sale of goods with such a sign, says Delcredere’s lawyer Yegor Kovalev, referring to the norms of the law on a public offer (Article 494 of the Civil Code of the Russian Federation). According to him, it would be possible to talk about a violation of consumer rights if several samples of the same product were marked with a “not for sale” sign.
Employees at most stores were unable to specify when sales would resume. One outlet in Moscow expects shipments in September, while a store in Novosibirsk says goods should arrive “within two weeks.”
An employee of one of the Moscow outlets explained what was happening with “problems with parallel imports.” But Huawei is not on the list of products for which imports are allowed without the consent of the brand owner. In a store in Chelyabinsk, Kommersant was told that they could not establish parallel imports, as they were the official retailer of Huawei. In June, RIA Novosti reported that Huawei, due to a shortage of goods, began to close some points – in particular, stores in Novokuznetsk, Ufa and Rostov-on-Don stopped working.
However, not all Huawei retailers have experienced problems. According to the company’s website, there are 13 Huawei mono-brand stores in Russia, nine of which are managed by Premium Retail. In Moscow, there is a Huawei store in the Seasons shopping gallery of another operator (Volga LLC). The store on the electronics manufacturer’s website is called “authorized”, not branded. There were no prohibition signs on the price tags in this store, and the sales assistant told Kommersant that all the equipment on display can be bought.
The problems in the stores of Premium Retail LLC were preceded by a lawsuit by the company itself against the Russian subsidiary of Huawei (Huawei Tech Company LLC), evidenced by the decision of the Moscow Arbitration Court dated July 26. The operator wanted to recover 3.6 million rubles from Huawei. debt for the management of company stores. In June and July, after the lawsuit was registered in court, Huawei transferred the body of the debt to Premium Retail, after which the plaintiff demanded interest for two periods – from December 28 to March 31 and from April 1 to the debt repayment date. The court satisfied the claim in part and decided to recover 98.6 thousand rubles. taking into account the cost of state duty.
To what extent the retail restrictions are related to the relationship between Premium Retail and Huawei, and to what extent to the objective difficulties of supply, is unknown. But a Kommersant source on the market says that the Chinese manufacturer has changed the format of cooperation with branded stores: “If earlier devices were supplied directly, now they are delivered through partners.” According to him, the structure of deliveries is also changing, the processes “are not fully debugged and do not yet allow bringing equipment to Russia in the required volumes.”
