GAZ refused to register a trademark for the production of souvenirs

The Gorky Automobile Plant of the GAZ Group failed to challenge the refusal of Rospatent to register the rights to a stylized image of a flying bird that adorned the grille of Chaika cars. The automobile plant applied for registration of a logo in the category of toys for the production of souvenirs with the symbols of the Soviet limousine. However, a similar logo was issued as a protected trademark in 2019 by the Perm car dealer Verra Group.
GAZ referred to the fact that the Chaika emblem does not evoke unambiguous associations with the Verra Group trademark. However, the intellectual property court ruled in favor of Rospatent, considering that both logos are confusingly similar, and GAZ also missed the deadline for claims. The car factory said that they would seek registration, since GAZ owns exclusive rights to both the Chaika car brand itself and the stylized image of seagull wings as a work of industrial design.
