The Ministry of Economy has criticized the draft order of the Ministry of Digital Development, which introduces new requirements for ensuring protection against emergency situations (ES) for critical infrastructure facilities. These include objects of state administration, IT and telecom infrastructure. The new measures will lead to an unreasonable increase in costs for businesses, according to the Ministry of Economy. Kommersant got acquainted with the opinion of the Ministry of Economy on the draft order developed by the Ministry of Digital Development. The document lists the requirements for emergency protection of critical infrastructure facilities of organizations (CVO), whose activities are regulated by the Ministry of Digital Development. The draft was posted on July 26 for public discussion on the regulation.gov.ru portal.
The document assumes, in particular, that these organizations should ensure the monitoring of natural hazards and man-made processes that can lead to emergencies, engineering and technical measures to prevent the occurrence of emergencies, as well as the preparation of infrastructure for work in emergency situations, the creation of a local warning system, training employees, ensuring interaction with the Ministry of Emergency Situations, creating financial reserves for the elimination of emergencies and other measures.
The Ministry of Economy notes in its response that the implementation of these measures will lead to additional costs for businesses: “In order to comply with the requirements, organizations will need to expand the staff by an average of three to six employees. Based on the average salary in the country, the cost of one organization to comply with the requirements can be about 2-4 million rubles. in year”. The Ministry of Digital Development told Kommersant that the project is being finalized taking into account the conclusion of the Ministry of Economy.
The CVOs are divided into three categories depending on their level of significance and the danger of their termination, explained Yakov Bulut, a lawyer for the Moscow City Civil Defense Bureau “De Jure Lawyers’ Bureau”. Various communication facilities are controlled by the Ministry of Digital Transformation of the KVO, respectively, the document under discussion will primarily be important for telecom operators and other organizations, as well as for Roskomnadzor, he added. KVO may include objects of state administration, information and telecom infrastructure, including organizations of television and radio broadcasting and mass media, added Anzhelika Reshetnikova, lawyer, head of practice at AB KIAP. In her opinion, the Ministry of Digital Development decided to develop measures in connection with the “growth of threats of destruction in the border areas of Russia.”
Telecom operators already belong to critical information infrastructure (CII) objects, and the extension of requirements for CVO to them threatens to increase bureaucratic costs, says Alexei Amelkin, president of the Makatel association. The initiative of the Ministry of Digital Development needs to be worked out, Andrey Guk, CEO of the Obit provider, adds: “It is not yet possible to unambiguously interpret all the requirements for telecom operators.”
The Akado representative agrees with the Ministry of Economy and considers the requirements of the draft order excessive: “For us, for example, the cost of executing the order may increase several times.” At the same time, the company already has services that perform the work necessary for the uninterrupted functioning of critical infrastructure, including in emergency situations, they emphasized. MTS, VimpelCom, MegaFon, Tele2, ER-Telecom, Radio Research Institute declined to comment. Russian Post, Rostelecom did not answer Kommersant.
