The amendments adopted in July last year oblige all personal data (PD) operators to inform Roskomnadzor of their intention to transfer data to other countries. At the same time, the cross-border transfer of personal data may be prohibited or limited to protect the fundamentals of the security of the Russian Federation, morality, health, rights and legitimate interests of citizens.
Aeroflot’s report draws attention to the fact that the amendments oblige PD operators to obtain certain information from the authorities of foreign states, individuals and companies to whom cross-border transfer of personal data is planned. However, the operator must obtain these data before the start of the cross-border transmission activity.
Since foreign states, individuals and companies are not required to provide such information, as a result, cross-border data transfer will depend on the goodwill and economic interest of a foreign partner in complying with Russian law, the air carrier emphasized. Goodwill is unlikely in unfriendly countries, the report says.
“In view of the foregoing … Aeroflot may find itself in a situation of forced suspension / termination of international flights in directions where the authorities of foreign states, foreign individuals and foreign legal entities, which PJSC “Aeroflot”is obliged to transfer personal data of passengers in accordance with local law, will not provide all the necessary information,” the company noted.

On March 1, 2023, a ban on the use of foreign messengers in the provision of financial and government services came into force in Russia. The corresponding article was approved in the law “On Information” at the end of December 2022. On the morning of March 1, the RKN published on the official website of the department a list of nine instant messengers that are subject to the new regulation. The list includes such services as Telegram, WhatsApp (included in Meta recognized as extremist and banned in Russia), Viber, Microsoft Teams, Skype, Shapchat, Wechat and Threema.
