A draft law has been submitted to the State Duma that will allow all constituent entities of the Russian Federation to establish a fee for changing the type of use of a land plot. The bill was developed by the State Assembly – Kurultai of the Republic of Bashkortostan. The project, if adopted, will make changes to Article 37 of the Town Planning Code of the Russian Federation.

“If there are approved rules for land use and development, the types of permitted use of land plots are chosen by the owners independently without additional permits, approval or payment of fees,” says the explanatory note note.

It is clarified that in “certain cases” changing the type of plot occurs for a fee. Thus, a fee for changing the type of use of a site is charged in Moscow and the Moscow region. The authors of the bill propose to grant the right to set fees to all subjects of the country.

The abolition of the reduced land tax rate for plots for individual housing construction used in business activities has led to new disputes in practice.
