It is proposed to reduce the minimum debt threshold for the possibility of using such a procedure from 50,000 to 25,000 rubles, and increase the maximum from 500,000 to 1 million rubles. In addition, it will be possible to re-initiate bankruptcy not after 10, but after 5 years.
The bill provides for the possibility of out-of-court bankruptcy seven years after the start of compulsory debt collection from citizens. Pensioners and Russians, whose only income is social payments, will be able to do this a year after the start of the collection. Now the Russians do not have such an opportunity, since the bailiffs do not complete the enforcement proceedings due to the fact that citizens have income.
At the first stage, in order to initiate the bankruptcy procedure, you will need paper certificates of the presence of unfinished enforcement proceedings, receipt of state benefits for children. From July 1, 2024, a transition to electronic receipt of information from the FSSP and the Social Fund is expected.
The number of extrajudicial bankruptcies of citizens in the first quarter of 2023 has grown almost double. 2510 procedures initiated, which is 95.9% more than in January-March 2022. In total, during the period of existence of out-of-court bankruptcy from September 2020 to March 2023, 16,075 procedures were initiated with a total debt of citizens in the amount of 5.55 billion rubles. RUB 3.82 billion written off debts.
