There is no conflict in the law that would prevent the Federation Council (SF) from promptly appointing a new head of the Accounts Chamber (SP) after the resignation of Alexei Kudrin, the State Duma and the Federation Council told Vedomosti.

The existence of such a conflict was previously announced to RIA Novosti by the first deputy head of the Federation Council committee on budget and taxes, Sergei Ivanov, who represents the upper house of parliament in the joint venture. He considered that the change of the chairman of the joint venture is possible only after the relevant law is updated. In accordance with the new version of the Constitution, the head of the joint venture is appointed and dismissed by the upper house, and not the lower one, as before, but the corresponding amendments to the law on joint venture after 2020 have not been made.

According to Andrei Klishas, ​​head of the Federation Council Committee on Constitutional Legislation, Ivanov is right that "a new law should be adopted in pursuance of the Constitution." "That's right, but Constitution possesses supremacy and supreme legal force,” he explained to Vedomosti. “The Constitution is a law of direct action and the absence of sectoral norms in no way affects the operation of the Basic Law, which should guide all public authorities.”

Dmitry Vyatkin, a member of the State Duma Committee on State Construction, deputy chairman of the United Russia Duma faction, agreed with him. “There is no conflict in this case. The Constitution is a document of direct action and its norms, especially those that are not referenced, are applied directly, - he said in a conversation with Vedomosti. - In this case, the norm is clearly formulated. And there is no need to explain that the Constitution takes precedence over federal laws.”

Earlier sources from RIA Novosti, TASS, RBC and other publications reported that the current head of the Accounts Chamber, Alexei Kudrin, may soon leave it for a position at Yandex. “Kudrin may indeed soon get another job, we are talking about Yandex,” the TASS source said. “The procedure will be carried out in accordance with the law and in the interests of both the state and the company.” The actual decision to move Kudrin to another position has already been made, he believes, and will be formalized on November 30 or December 14 (both November 30 and December 14 are Wednesdays, and meetings of the Federation Council are held on Wednesdays).
