The first in Russia criminal case on evasion of mobilization was canceled by the prosecutor's office
The head of the Agora international human rights group, Pavel Chikov, announced the end of the criminal proceedings on draft evasion as part of partial mobilization against a 32-year-old resident of Penza (Article 328 of the Criminal Code of the Russian Federation). This business became the first criminal trial in Russia in the case of evasion from mobilization. He was brought up on October 5th.
“The Prosecutor's Office of the Penza Region honored the Plenum of the Supreme Court and recognized the decision to initiate proceedings as illegal. The suspect received the right to rehabilitation, including compensation (harm) caused by the 48-hour detention,” said Pavel Chikov in Telegram.
According to the decision of the plenum of the Supreme Court of 2008, “the subjects of the crime under Part 1 of Art. 328 of the Criminal Code, are male citizens from 18 to 27 years old, subject to conscription for military service.
According to consequencesOn September 23 of this year, a resident of Penza received a summons and had to appear at the military registration and enlistment office of the Kondolsky village council of the Penza region by September 26. The man did not come to the recruiting office.
