Russian woman sued plastic surgeons for poor-quality operations

More than 850 thousand rubles were sued by the client of the medical center for unsuccessful body plastic surgery. The woman underwent a number of operations on her stomach, buttocks and chest, but the result was shocking.

As MK managed to find out, at the beginning of 2022, Elizabeth (all names have been changed) went to the plastic surgery clinic to put her body in order after giving birth. She signed a contract, and at the end of January she was operated on. Elizabeth underwent tummy tuck (excision of excess skin and fat deposits), liposuction of the anterior abdominal wall, lateral sections of the abdomen and back. As well as lipofilling of the buttocks and mammary glands (transplantation of adipose tissue from one zone to another) and breast lift. The patient spent the next three days in the hospital and was then discharged.

However, after the interventions, Elizabeth did not find positive changes in her figure. According to her, during the operation, the doctor violated the markings on the body, it also turned out that the seams were longer than planned, and were placed crookedly and with creases. Despite the liposuction, the woman did not notice that her volumes had decreased, in addition, rough, torn scars remained on her body. Lipofilling of the buttocks and chest also did not lead to any external changes. The breast lift did not give the expected result.

The woman decided to punish would-be doctors and filed a lawsuit with the Sergiev Posad court. She demanded that the clinic return the money for the operation – 255,000 rubles, pay 1,000,000 for non-pecuniary damage, a fine of 50% of the amount awarded by the court, and reimburse court costs in the amount of 50,000 rubles.

Representatives of the clinic at the trial refused to admit they were wrong. The doctors said that they fulfilled the terms of the contract: they tightened the client’s breasts and removed excess fat. One of the doctors explained that she saw the woman after the operation and was satisfied with the result. The medic added that beauty is an evaluation category, so there can be no objective opinion on this issue.

To verify the arguments of the dissatisfied client, an outpatient forensic examination was appointed. Having studied the documentation, the experts identified a number of significant violations on the part of the clinic at different stages of interaction with the patient. The staff of the center did not issue a medical card, did not sufficiently examine her before and did not observe her after the operation.

As a result, the court decided to partially satisfy the requirements of the patient. The clinic was ordered to pay 255,000 rubles paid by Elizabeth for the provision of paid medical services, 300,000 rubles as compensation for non-pecuniary damage, a fine of 277,500 rubles and 30,000 rubles for lawyer expenses.
