Putin allowed the defendants to sign contracts with the Ministry of Defense - Kommersant
President Vladimir Putin signed two laws exempting defendants who entered into a contract with the Ministry of Defense during mobilization or wartime from criminal liability. First allows the conclusion of contracts with defendants at the stage of judicial proceedings, second - suspend criminal proceedings and subsequently release from liability.
Previously, defendants could enter into a contract with the Ministry of Defense before the case went to trial and after the verdict. Now you can conclude contracts with the Ministry of Defense and go to a combat zone while a criminal case is being considered by the court. The laws signed by the president amend the Criminal Code, the Criminal Procedure Code and the law on military service.
Changes to the Code of Criminal Procedure suggest that the court can suspend criminal proceedings and subsequently release the defendant from liability if he signs a contract for military service during the period of mobilization or in wartime. It is also possible to suspend legal proceedings in relation to persons who committed crimes during military service. The court may also suspend criminal proceedings if a sentence has been passed but has not entered into force.
Changes to the law “On Military Duty and Military Service” provide that an agreement on military service during the period of mobilization can be concluded with the accused at the stage of judicial proceedings - when the criminal case has already been sent to the court for consideration on the merits or is under appeal.
A package of amendments to the Code of Criminal Procedure, developed by the Supreme Court, was submitted to the State Duma on August 23. On August 29, corresponding amendments to the law on conscription were proposed by the chairmen of the Federation Council and State Duma committees on state building, Andrei Klishas and Pavel Krasheninnikov, as well as the head of the Duma defense committee, Andrei Kartapolov (all United Russia). On September 24, the State Duma adopted the amendments in the second and third readings. On September 25, the package of laws was approved by the Federation Council.
