A draft law on credit holidays for citizens called up as part of partial mobilization and employees under contract has been submitted to the Duma. The law does not yet have retroactive effect, but, according to its authors, there is already a position agreed with the government that this provision will be included in the document. The law is supposed to be adopted as soon as possible, perhaps even in three readings at once.

On Friday, September 23, the State Duma was submitted bill, which was designed to protect the rights of borrowers who are called up for military service by mobilization or undergoing military service under a contract, as well as those who are dependent on them. According to the document, such a borrower can receive a full deferment of loan payments for the duration of service or reduce the amount of payments for this time. In addition, the bill provides for the complete or partial termination of obligations under the loan of a dependent or a military person, in the event of the death of the latter.

As one of the authors of the bill, Anatoly Aksakov, head of the State Duma Finance Committee, told Kommersant, the document was agreed with the government and should provide those called up under partial mobilization and contract employees with the opportunity not to think about the problems left in the "citizen". “This law gives the right to credit holidays, and not the obligation to use them, so those who do not have problems with monthly loan payments can continue to pay it off in the same mode, but for someone it may turn out to be problematic, even purely technically - they this law will help to avoid delinquencies and deterioration of credit history,” he explained. Moreover, according to Mr. Aksakov, an agreed position has already been worked out that the law will have retroactive effect and apply to everyone participating in the SVO.

“I offered to take part of the payments on the loan to the state, but so far there is a discussion on this issue,” Anatoly Aksakov said.

In any case, the deputy is sure that the law should be adopted as soon as possible and, possibly, in three readings at once.

The idea of ​​shifting to the state part of the payments on loans mobilized is positively assessed bankers. So, according to the head of the National Financial Markets Service Andrey Yemelin, after the jump in the key rate of the Central Bank, the state took over the payment of part of the interest on loans to small businesses with a floating rate. And in this case, in his opinion, it would be an ideal design. “Moreover, at the moment, the potential scale of such vacations is completely unclear, and in any complex and large-scale system with many uncertain variables, it is always calmer and more reliable when a powerful state shoulder is nearby,” says Mr. Emelin.

The timeliness of the bill and the consistency of its main provisions are also noted by human rights activists. At the same time, according to Yevgeny Lazarev, coordinator of the project of the People's Front "For the Rights of Borrowers", the proposal to pay the part of the debt for the drafted by the state is not so clear. “Of course, I would like to release as much as possible from credit obligations those who go to defend their homeland, but, firstly, they are paid a salary, and secondly, there will be unequal conditions between those who took loans and those who did not take them,” she says. At the same time, according to Anatoly Aksakov, in order not to violate the principle of equality, this issue may be resolved through additional payments.
