The White House extended until 2030 a moratorium on almost all scheduled business inspections - such control will now remain only for objects of extremely high and high risk. Unscheduled inspections will be carried out only on the basis of risk indicators - so far the departments have been reluctant to resort to this tool, but severe restrictions may encourage controllers to switch to a risk-based approach.

The government extended until 2030 the moratorium on most scheduled business inspections - a decree on this (No. 372 of March 10, 2023) was approved by Prime Minister Mikhail Mishustin. Now the supervisory agencies will be able to conduct scheduled inspections only in relation to objects of control of categories of extremely high and high risk of harm, as well as hazardous production facilities and hydraulic structures of hazard class II. There are six categories of risks in total, the remaining ones - objects of moderate, medium and significant risk - will be completely exempt from scheduled inspections.

The office of Deputy Prime Minister Dmitry Grigorenko explains that about 780 thousand out of 4.7 million objects are classified as extremely high and high risk. “We are talking about planned inspections. Plans for their implementation are formed in advance for the next year. They are sent by the control bodies to the prosecution authorities and are agreed upon by them at the end of the year. Considering that the government has established that in the period up to 2030, scheduled inspections are carried out only in relation to facilities classified as extremely high and high risk, according to our estimates, more than 150,000 scheduled inspections were not included in the plans this year. ”, - they assess the scale of the indulgences there.

Thanks to the 2022 moratorium, businesses de facto lived without inspections: if in 2019 there were 1.5 million inspections, in 2020, under the moratorium, their number decreased to 400 thousand, in 2021, taking into account the removal of covid restrictions, it increased up to 880 thousand, and in 2022 only about 340 thousand were carried out: 238.9 thousand were scheduled inspections, 99.5 thousand were unscheduled. Experts from the Higher School of Economics and the Russian Union of Industrialists and Entrepreneurs recognized the benefit of the moratorium - the liberalization of control did not lead to negative consequences, and the emphasis shifted from inspections to prevention - such measures affected 897.4 thousand companies in the Russian Federation.

Unscheduled inspections will remain, but will also be subject to the logic of a risk-based approach. They can now be carried out on the basis of indicators of the risk of violation of mandatory requirements - signs that violations have been or may be committed at the control object with a high degree of probability. As Secretary of State, Deputy Head of the Ministry of Economy Alexei Khersontsev told Kommersant, although 187 risk indicators were formally approved, in practice, only 520 out of 340 thousand inspections were carried out on their basis in 2022. Rigid binding of unscheduled inspections to risk indicators should encourage departments to finalization. “The practice of applying a risk-based approach has shown the need to improve them, and somewhere to develop new ones instead of existing ones. This process is designed for the whole of 2023,” Dmitry Grigorenko’s office added.
