How to change the type of permitted land use - Economics - Kommersant


Rosreestr in some detail clarifies procedures to be followed in case the actual use of the land does not correspond to the permitted one. Let us explain that in total there are 13 types of permitted land use (VRI) - it is determined by local authorities based on the historical conditions for the use of each territory, as well as based on the results of public hearings. Some species can be chosen by the right holders of the plots, while others - after obtaining permission. At the same time, the plots cannot be used for some types of activities, which is explained by the protection of the population and the provision of comfortable living conditions.

To change the type of permitted use, Rosreestr proposes to be guided by the rules of land use and development (if they are adopted by regional or local government agencies). Further, in the absence of legislative restrictions, the right holder of the site can independently, without additional permits and approvals, choose the type of permitted use of the land plot from among the types provided for by the urban planning regulations. To do this, you will need to submit an application to the MFC about the selected type of permitted use of the land.

If the right holder decides to change the VRI to a species classified as conditionally permitted, then the consent of the authorized body will be required after public discussions or hearings. At the same time, Rosreestr warns that a change in the type of permitted use of the site may affect its cadastral value, as well as the amount of land tax.

Note that the procedure itself looks laborious: the right holder will need to find the land use and development rules (LLD) with a list of VRI, as well as independently verify that there are no legislative restrictions on filing an application to change the VRI. At the same time, the procedure for actions in the event of the absence of approved PPPs is not further explained.
