But the objective impossibility of returning home for men subject to mobilization can be regarded as draft evasion, for which administrative punishment is provided.

Nobody wants to be in the same situation. But what if there is no agenda in hand – not yet – but the vacation is already planned? To fly – or not to risk? After all, today no one can even say with certainty what will happen tomorrow, not to mention how the situation may change in the next 10 days – two weeks – during the period for which people usually go on vacation.

The wife guessed her vacation, the children were asked to leave school. We sit and don’t know what to do.

Rostourism and ATOR, railway and airlines claim that there are no restrictions. Formally, any vacationer who has not received a summons can go anywhere. To Belarus, Kazakhstan, Kyrgyzstan and Armenia with only one Russian passport.

With “foreign”, but without a visa, but with transfers, you can fly to as many as 25 countries, including Thailand, Georgia, Montenegro, Serbia, Mongolia, Moldova, Tunisia, etc. If a visa is successfully issued or the Schengen visa continues to operate, theoretically it is possible travel to most countries in the world. Except, of course, those that are completely fenced off from the Russians.

It will not work at all, for example, to get into the Baltic states, and not at all because of mobilization, but because of sanctions. Since the beginning of September, Latvia, Lithuania and Estonia not only do not issue visas for Russian citizens, but do not even let transit travelers – holders of the “Schengen”. With the exception of relatives of EU citizens and some other categories. Just do not favor their neighbors and former partners in the socialist camp in Poland. The same strict rules apply in the smoky Netherlands. Two more neighbors, Finland and the Czech Republic, are threatening to close borders and visas.

“But I would not say that there is a flow to countries where entry by Russians is already closed,” says Svetlana Paramonova, a representative of the tour operator. – People read the news. And, nevertheless, in most countries, so to speak, openly, even in Europe it is quite possible to get.

The main difficulty for us now is the legal interpretation in case the client refuses the tour. Our legal adviser says partial mobilization is not force majeure. On the other hand, one can understand people who are now canceling flights and tours. Here are just legal grounds for the return of the full cost of vouchers, we do not have. And if a person is called, he received a summons, and he has a ticket … I don’t have a conclusion yet, I can answer you.

As for what to do in general in conditions where a person fit for military service is also a vacationer, Andrey Kartapolov, Chairman of the State Duma Committee on Defense, spoke most definitely. “Relax at the resorts of the Crimea and the Krasnodar Territory,” he said. Like, you don’t need the Turkish coast, wait with it for now.

“I follow the situation, of course, and I don’t see any legal acts on the topic of departure formally suitable for partial mobilization,” says lawyer Stanislav Popov. – It is clear that there is a right of citizens to freedom of movement.

On the other hand, the law “On mobilization” says that from the moment it was announced, those registered with the military are prohibited from leaving their place of residence without the permission of the military commissar or local authorities. Again, the circumstances of obtaining such a permit are not very clear, and even the starting point for the start of its action. Yes, even in a situation where mobilization is partial.

So there seems to be no legal basis for forbidding a person to go on vacation. But there was no law enforcement to comment on.

And so, as a human being, I will say – it is better now to refuse a trip, especially a foreign one. Especially if a person directly falls under the partial draft: fit for combat, age up to 35, served in the army, has a military specialty … Not only would I not recommend flying abroad, but also to the resorts of the Krasnodar Territory. Draft evasion implies a large fine, and if it is malicious, then a punishment of 18 months to 2 years.
