Bar Association: the annual turnover of the shadow market of medical services in Russia reaches 215 billion rubles



The Russian healthcare system and legislation do not give a doctor the opportunity to obtain the status of an independent subject of civil law relations, which is why medical workers are often forced to provide services in a "gray" field. According to the Moscow Bar Association "Aronov and Partners", the turnover of the market of all medical services in Russia is more than 3 trillion rubles, approximately 7.5-15% of this amount is the income of the shadow market (at least 215 billion rubles).

As the managing partner of the board, Alexander Aronov, said during the conference, “Pharmacy and healthcare: tasks of the new time”, organized by Kommersant, the shadow market of medicine is divided into several components:

  • Violations of established standards of activity and accounting - for example, writing off alcohol;
  • Services of a “general criminal” origin - misuse of drugs, sale of organs, and others;
  • Manufacture of counterfeit products;
  • "Household" medical business - the provision of private services without a license and without the participation of a medical organization.

According to Mr. Aronov, the key problem in the development of the latter component is the absence of the concept of “doctor” in the current legislation: the concepts of “attending physician” and “health worker” are spelled out - this indicates that in Russia the key link in the healthcare system is not the doctor himself. , and the clinic.

He said that the National Association of Healthcare Managers tried to analyze this factor. It turned out that often a doctor in the legal field cannot compensate a patient for his mistake: 80% of Russian doctors work in state institutions, the bulk of their funding goes to salaries, and no money is provided for compensation in the budgets. The doctor himself, due to the lack of an independent status, cannot insure his professional liability, therefore the patient who has been harmed does not go to the doctor directly, but to the Investigative Committee (IC). Compensation for such claims, as a rule, is small, as a result, the patient receives almost nothing during the litigation, and the doctor's reputation is damaged.

To change this system, the association, according to Mr. Aronov, proposes to create a "parallel legal order." What should it be:

  • doctors who do not want to work through clinics will be able to obtain an independent status, by analogy with the status of a lawyer, such doctors will be able to work with clinics by renting premises from them;
  • a doctor with such status will have to insure his liability;
  • regional and federal chambers of doctors will be created, which will be able to exclude a negligent colleague from their membership.

Mr. Aronov, during his speech, cited the results of a recent survey of the Doctor's Directory platform, during which it turned out that 87% of Russian doctors support the introduction of private practice, 77% would take advantage of this opportunity themselves.
