The Anacondaz group is demanding that the departments of the Ministry of Internal Affairs for Perm and the Perm Territory compensate for losses from the disruption of the concert on July 23 at the local Michurin club in the amount of 255 thousand rubles. Regional arbitration proceeded to consider the relevant claim. The artists consider illegal the actions of the police, who interrupted the group’s concert “without explanation.” The Ministry of Internal Affairs refers to the forced evacuation of spectators and the artists themselves due to violations of fire safety rules. Anacondaz’s lawsuit against the authorities and the police is also being considered in Yekaterinburg, where the concerts were canceled, according to the group’s representatives, for political reasons.

lawsuit Invisible Promo LLC, the official organizer of Anacondaz concert tours, entered the Arbitration Court of the Perm Territory on August 30. The Anacondaz concert in Perm was scheduled for July 23 at the Bereg event space on the banks of the Kama. Two days before the concert, the performance of the artists was moved to the Michurin club. Anastasia Shardakova, a representative of Invisible Promo, explained in court that the organizer of the concert, IP Gleb Yuryev, considered the club a “more suitable venue” for the event. Under the terms of the contract, the concert had to last at least 60 minutes. However, after the fourth song, the band’s performance interrupted employees of the police department No. 1 of the Ministry of Internal Affairs of Russia in Perm.

The police, without explanation, demanded that the audience and artists leave the premises, Ms. Shardakova said, and the tour manager and sound engineer were asked to proceed to the department. Taking written explanations about the circumstances of the concert, law enforcement officers released them without drawing up protocols. Since the concert was not completed, IE Gleb Yuryev returned the money for the tickets to the audience, and Anacondaz did not receive the remuneration in the amount of 255 thousand rubles stipulated by the contract.

“We believe that the losses incurred by the plaintiff as a result of non-receipt of the fee are subject to recovery from the defendants,” said Anastasia Shardakova.

The representative of the Ministry of Internal Affairs for Perm presented her version of events. On July 23, police department No. 1 received operational information that the Michurin club was hosting an event with the participation of a large number of people, she said: “Police officers are required to go to each mass event to check if any violations.” On the spot, the police found that fire safety standards were violated during the concert: the small area of the club did not allow the density required for such events (1 person per 1 sq. m.), and the exits from the premises were blocked. In total, according to the management, there were 320 spectators at the concert, the representative of the Ministry of Internal Affairs did not name the exact area of the club, but noted that “the footage was clearly inadequate.” “Having discovered these violations, the police began to demand that citizens leave the premises for security purposes. They didn’t do anything illegal. Everything happened within the framework of the law and for the benefit of citizens – spectators and artists. In this regard, we consider the stated requirements unreasonable,” said the representative of the Ministry of Internal Affairs for Perm.

In the Main Directorate of the Ministry of Internal Affairs of Russia for the Perm Territory, they supported the position of their colleagues. The representative of the regional headquarters said that after the interrupted concert, the Ministry of Emergency Situations conducted an inspection at the Michurin club, the violations were confirmed, and the owner of the premises, IP Alexei Protchenko, was brought to administrative responsibility. “We believe that the actions of officials of the Ministry of Internal Affairs of Russia to evacuate citizens from the premises were legal and justified, there are no grounds for claiming damages. In addition, we believe that neither we nor the department of the Ministry of Internal Affairs for the city of Perm are causing losses. The agreements were concluded between the plaintiff and entrepreneurs, in this situation they will be the perpetrators of harm, ”said the representative of the regional Main Directorate of the Ministry of Internal Affairs.

Consideration Anacondaz’s lawsuit against the Perm police will continue on November 2. Yury Tokarev, the head of the economic security and anti-corruption department of the Perm police department No. 1, who was in charge of the leadership during the police visit to the club, will be summoned to the court to give explanations.

Judge Elena Zavadskaya also pointed out that the requirement of Invisible Promo LLC to recognize the actions of the police as illegal is beyond the jurisdiction of the arbitration court, and it will need to either be clarified or singled out and sent for consideration to a court of general jurisdiction.

Last week, consideration began of a similar lawsuit by Anacondaz against the authorities and the police in Yekaterinburg, where two planned concerts of the group were cancelled. Lawyer Alexei Bushmakov, representing the interests of Anacondaz in the Leninsky District Court of Yekaterinburg, suggested that the reason for the disruption of the concerts could be Anacondaz getting into the list of “undesirable” artists in Russia. Earlier, the musical group spoke out against the special military operation of the Russian Federation in Ukraine.
